Welcome to Sacred: Bible & Daily Devotion ("Sacred," "the App," "we," "us," or "our"). Sacred is a mobile application developed and operated by Ian Marco ("Developer," "Company"). By downloading, installing, accessing, or using Sacred, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Ian Marco. Please read them carefully before using Sacred. By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Acknowledgement
You acknowledge and agree that these Terms are concluded between you and Ian Marco only, and not with Apple Inc. ("Apple"). Ian Marco, not Apple, is solely responsible for Sacred and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the date you agreed to these Terms.
Apple is not a party to these Terms and has no obligation to furnish any maintenance or support services with respect to Sacred.
2. Scope of License
Subject to your compliance with these Terms, Ian Marco grants you a limited, non-exclusive, non-transferable, revocable license to download and install Sacred on any Apple-branded device that you own or control, and to use Sacred for your personal, non-commercial purposes in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You may not:
- Distribute, sublicense, lease, rent, lend, or transfer the App to any third party.
- Copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).
- Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App.
- Use the App for any unlawful or unauthorized purpose.
If you sell or transfer your Apple device to a third party, you must remove Sacred from the device before doing so.
3. Description of the Service
Sacred is a Christian devotional application that provides daily devotionals with curated biblical content at beginner, intermediate, and advanced levels, available in English and Spanish. The App also includes daily Bible verses, guided prayers organized by emotional categories, access to Bible text and professional narrated audio through licensed third-party providers, and a Bible Chat feature powered by AI for exploring Scripture.
Content availability may vary and is subject to change without prior notice. Some features require an active subscription.
4. Subscriptions and Payments
Sacred offers auto-renewable subscription plans that provide access to premium content and features. Details about current subscription offerings, including pricing, duration, and included features, are displayed within the App at the point of purchase.
Sacred may offer a free trial period. If a free trial is offered, you will not be charged during the trial period. At the end of the free trial, your subscription will automatically convert to a paid subscription at the price displayed at sign-up, unless you cancel at least 24 hours before the end of the trial period.
Your subscription will automatically renew at the end of each subscription period (weekly, monthly, or annually, as applicable) unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. Payment is processed through Apple's In-App Purchase system. All payments are processed by Apple, and Ian Marco does not directly collect or store payment information. Prices are displayed in your local currency and may vary by region.
You may manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you have already paid for. No refunds or credits will be provided for partial subscription periods.
All purchases are made through Apple's payment system. In the event that Sacred fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if applicable). For refund requests related to subscriptions, please contact Apple Support directly through reportaproblem.apple.com.
5. Account Registration and Deletion
Certain features of Sacred may require you to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may initiate the deletion of your account at any time directly within the App by navigating to Settings > Account > Delete Account. Upon account deletion, your personal data will be permanently deleted in accordance with our Privacy Policy. Your access to premium features and content associated with your account will be terminated. Any active subscription should be canceled separately through your Apple ID Account Settings to avoid future charges. Account deletion is irreversible and previously stored preferences, progress, and personalization data cannot be recovered.
We will process account deletion requests within 30 days and will confirm completion via the email address associated with your account.
6. Content and Intellectual Property
All content available through Sacred, including but not limited to devotional texts, images, graphics, audio, software code, and design elements, is the property of Ian Marco or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms and your active subscription (where applicable), we grant you a limited, non-exclusive, non-transferable, revocable right to access and view the Content for your personal, non-commercial, devotional use only.
You may not copy, reproduce, distribute, publish, display, perform, or create derivative works of any Content. You may not use any Content for commercial purposes, remove or alter any proprietary notices from the Content, or use automated means to access or collect Content from the App.
Bible text and audio content is provided through licensed third-party services. The use of such content is subject to the terms and restrictions imposed by the respective licensors. Sacred does not claim ownership of biblical texts.
7. AI-Powered Features
Sacred includes AI-powered features, such as the Bible Chat functionality. By using these features, you acknowledge and agree that AI-generated responses are provided for informational and devotional purposes only and should not be considered a substitute for personal Bible study, pastoral counsel, or professional theological advice. While we strive for theological accuracy, AI-generated content may occasionally contain errors or inaccuracies. Your interactions with AI features may be processed by third-party AI service providers as disclosed in our Privacy Policy. We do not use your personal conversations with AI features to train AI models without your explicit, separate consent.
8. User Conduct
You agree to use Sacred only for lawful purposes consistent with these Terms. You shall not use the App in any manner that could damage, disable, overburden, or impair our servers or networks. You shall not attempt to gain unauthorized access to any portion of the App, other accounts, computer systems, or networks connected to the App. You shall not interfere with any other party's use and enjoyment of the App, use the App to transmit any malicious software, or use the App in violation of any applicable laws or regulations.
9. Maintenance and Support
Ian Marco is solely responsible for providing maintenance and support services with respect to Sacred. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Sacred. For support inquiries, please contact us at hi@sacredapp.com.
10. Warranty Disclaimer
To the maximum extent permitted by applicable law, Sacred is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the App will meet your specific requirements, that the App will be uninterrupted, timely, secure, or error-free, that the results obtained from the use of the App will be accurate or reliable, or that any errors in the App will be corrected.
In the event of any failure of Sacred to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Sacred.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Ian Marco be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or business interruption, arising out of or related to your use of or inability to use Sacred. In no event shall Ian Marco's total aggregate liability to you exceed the amount you have paid to us in the twelve months immediately preceding the event giving rise to the claim, or fifty US dollars (US $50.00), whichever is greater.
12. Product Claims
You and Apple acknowledge that Ian Marco, not Apple, is responsible for addressing any claims you or any third party may have relating to Sacred or your possession and/or use of Sacred, including product liability claims, claims that Sacred fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
13. Intellectual Property Claims
You and Apple acknowledge that, in the event of any third-party claim that Sacred or your possession and use of Sacred infringes that third party's intellectual property rights, Ian Marco, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
14. Third-Party Services
Sacred may integrate with or rely upon third-party services, including Bible content providers for Scripture text and narrated audio, subscription management services for processing and managing your subscription, and AI service providers for the Bible Chat and other AI-powered features. Your use of such third-party services may be subject to additional terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.
15. Content Availability and Modifications
We reserve the right to modify, update, add, or remove Content and features at any time without prior notice. We do not guarantee that any specific Content will remain available indefinitely.
16. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of its provisions. Upon termination, you must cease all use of the App, delete all copies of the App from your devices, and all licenses granted to you under these Terms shall immediately terminate. Ian Marco may also terminate or suspend your access to Sacred at any time, with or without cause, and with or without notice.
17. Indemnification
You agree to indemnify, defend, and hold harmless Ian Marco and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of Sacred, your violation of these Terms, your violation of any third-party right, or any claim that your use of Sacred caused damage to a third party.
18. Age Requirements
Sacred is intended for users of all ages. However, users under the age of 13 must have permission from a parent or legal guardian to use Sacred and create an account. By allowing a minor to use Sacred, you represent that you are the minor's parent or legal guardian and that you accept these Terms on the minor's behalf.
19. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Argentine Republic, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Autonomous City of Buenos Aires, Argentina.
20. Apple as Third-Party Beneficiary
You and Ian Marco acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
21. Compliance with Legal Requirements
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
22. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means prior to the change becoming effective. Your continued use of Sacred after the effective date of any modifications constitutes your acceptance of the modified Terms.
23. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
24. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ian Marco regarding your use of Sacred and supersede all prior agreements and understandings.
